Is Delta8 Legal In My State?

Across the United States, we are regularly questioned about the legality of psychoactive Delta8-THC and cannabis oils.

Since the Farm Bill was enacted in late 2018, CBD has been federally legal in the United States as long as it is produced from hemp and has less than 0.3% THC. However, although Delta8-THC is derived from CBD, the legal position of Delta8 varies by state, with some restricting its sale and use. Some jurisdictions, for example, prohibit Delta8-infused beverages and food products, as well as smokable delta8-THC hemp flower and D8 vapes. Vermont even has unique regulations in place for CBD & Delta8-infused maple syrup. To assist you in understanding Delta8 and CBD legislation, we have prepared state-by-state answers. Please keep in mind that, while we update this website on a regular basis, legislation and regulations are always changing.

Currently, Delta-8 is banned or sales restricted in Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Kansas, Kentucky, Idaho, Iowa, Michigan, Mississippi, Montana, Nevada, New York, North Dakota, Rhode Island, Utah, Vermont, and Washington.
